Verity AG (hereinafter referred to as “Verity”, “we” or “us”) undertakes to process all personal data (hereinafter referred to as “Personal Data”) in accordance with applicable data protection laws and to take appropriate security measures to protect such data from unauthorized access. In this Privacy Notice we inform you in particular about what Personal Data we collect and process in connection with the use of our websites www.verity.net and www.veritystudios.com (hereinafter referred to as “Website”), our services, our social-media presence, or by any other means, for what purposes it is used, to whom it may be passed on and what your rights are in connection with the use of your Personal Data by Verity. Personal Data is any information relating to an identified or identifiable natural person, e.g. surname, first name, address, e-mail address, IP-address, date of birth or telephone number. 

This Privacy Notice applies as far as the processing activities are not subject to other privacy policies or are provided for by applicable law. Please read this Privacy Notice carefully.  

By accessing our Website and using the services and products we offer, you declare that you have read this Privacy Notice carefully and agree to the data processing described. Any questions in connection with this  Privacy Notice can be sent by e-mail to dataprivacy@verity.net at any time. If you do not agree with our data processing policy as stated in this Privacy Notice, please refrain from accessing the Website and using our services and products. 

If you provide us with Personal Data of other persons, you must provide their Personal Data only if you are allowed to do so in line with applicable data protection laws and only if the other person would agree to you providing his/her Personal Data to us for the purposes the Personal Data are collected and the processing of his/her Personal Data according to our Privacy Notice. 

 

1. Responsible Party / Controller

Verity determines the purposes and means of processing your Personal Data and is therefore responsible for the processing and usage of your Personal Data in accordance with this Privacy Notice. If you have any questions or concerns about this Privacy Notice or the processing of your Personal Data, please contact us at any time by sending an e-mail to dataprivacy@verity.net. 

2. Data Processing 

All Personal Data collected via our Website or by any other means in connection with our products and services is processed in accordance with the Federal Data Protection Act (“FDPA”) and the GDPR. We collect and process Personal Data carefully and for the purposes described in this Privacy Notice. In accordance with applicable law, we may also use your Personal Data in ways other than those described in this Privacy Notice. In this case, we would provide you with specific privacy statements or notices at the time of collection and, where necessary, obtain your consent. We will always endeavor, as far as is reasonable, to process information only in anonymous or pseudonymous form so that we cannot identify you. 

3. Collection of Personal Data and Purposes of Data Processing 

3.1 Personal Data Automatically Transmitted via the Use of our Websites 

Verity collects and stores information that your browser automatically transmits to us in “server log files” when you visit our Website. This Personal Data is collected automatically and includes, for example: 

• Browser type and browser version 
• Operating system used 
• Referrer URL (the previously visited Website) 
• Host name of the accessing computer 
• Date and Time of the server request 

• Internet Protocol address (IP address; if necessary, in anonymized, shortend form) 
• Transmitted data volume 
• Language 
• Websites accessed 
• Amount of Personal Data transferred in each case 

• Other similar data and information which serve to avert danger in the event of attacks on our IT systems. 

This Personal Data is not merged with other Personal Data and is stored separately from any other Personal Data transmitted by the user. It is deleted by us after three to six months at the latest. 

Verity also collects Personal Data through cookies that are placed on our Website. For more information about our cookies, please see section 8 below. 

Verity uses the automatically collected Personal Data to fulfil the following purposes: 

• to enable the display, operation and functionality of the Website 

• to ensure the stability and security of the system 
• to improve and protect our services 
• for statistical purposes in the event of attacks on the network infrastructure on which the Websites is provided  

The legal basis for the data processing results from our legitimate interests (Art. 6 para. 6 FDPA, Art. 6 para. 1 sentence 1 lit. f GDPR) in carrying out the data processing for the purposes as described above. 

3.2 Personal Data Transmitted by the User to Us 

Verity collects and processes Personal Data that you voluntarily provide to Verity via an online form (e.g. to get in touch with us, to download our whitepaper or to sign up for our newsletter (for more information about our newsletters, please see section 10 below)) directly on our Website or via our contact e-mail address, via any other applications connected to our Website, by telephone or in any other way. This information depends on what you submit to us. As a rule, it includes the following Personal Data:  

• Last name, first name, e-mail address, company address, function, telephone number, additional information about you; 
• Subject and your message or your inquiry.  

The provision of this Personal Data is expressly on a voluntary basis, subject to your consent or for entering into a contract with us. Please note that without the provision of this information, the service requested cannot be provided or not in the desired quality. 

Verity uses the Personal Data you provide to us for the processing and answering your inquiry, or for the lawful purposes which were evident from the circumstances, which may include the following purposes: 

• to communicate with you and provide you with the best possible and personalized information that you require from us (e.g. about our products and services) 
• to offer or suggest new services and information that may be of interest to you 
• to provide, maintain, protect and optimize the services and information offered to you 
• for analysis purposes to improve our products and services 
• to comply with legal or other regulatory requirements and internal policies  

• to establish, exercise and/or defend actual or potential legal claims, investigations or similar proceedings 
• for other legitimate purposes if such processing is apparent from the circumstances or was indicated at the time of collection 

3.3 Personal Data Transmitted by our Contract Partners 

Verity collects and processes Personal Data from you as an employee or as an individual acting on behalf of our Contract Partners (e.g. suppliers, clients and other business partners and service providers) (hereinafter referred to as “Contract Partners”) via e-mail address, by telephone, letter mail, by granting access to our drone systems, or in any other way subject to our contract with them or to enter into a contract with them. As a rule, we collect the following Personal Data:  

• Last name, first name, company addresses, e-mail address, telephone number, IP address, passwords (two factor authentication), additional information about an employee; 

• The message or the inquiry of the Contract Partner.  

The provision of this Personal Data is always voluntary, based on the consent or a contract with the Contract Partner. We need this information for the proper establishment and execution of the contractual relationship and the fulfilment of the associated contractual obligations or if required by law. Without this information, we will generally not be able to conclude or execute the contract with our Contract Partner or provide the service in the desired quality.  

We will use the information we collect from our Contract Partners to provide the best possible service or support, which may include the following purposes: 

• to comply with and perform our contractual obligations towards our Contract Partners 
• to best answer their questions or requests regarding our products and services, to ask them questions and to provide additional information related to our products and services that is tailored to their inquiry or interests; 

• to communicate with them and to give them the best possible advice that they request from us before or during a contract; 
• to grant them access to our drone systems and enable them to manage and fulfill their tasks related to our services and systems;  
• to comply with legal or other regulatory requirements and internal rules;  
• to establish, exercise and/or defend actual or potential legal claims, investigations or similar proceedings; 
• for other lawful purposes, where such processing arises from the circumstances or was indicated at the time of collection. 

3.4. Personal Data collected by our drone systems 

Verity collects and processes Personal Data from our Contract Partners or employees of Contract Partners via our drone systems subject to our contract with them. Although not in scope, the drones themselves may occasionally collect Personal Data, which may include the following:  

• pictures, images or videos of Contract Partners.  

Before storing and processing of the pictures, images or videos, faces captured on images are irreversibly blurred.  

The provision of this Personal Data is required, to fulfill the services subject to our contract with our Contract Partners. Please note that without the provision of this information, the service requested cannot be provided or not in the desired quality. 

We will use the information we collect from our Contract Partners to provide the best possible service or support, which may include the following purposes: 

• to comply with our contractual obligations towards our Contract Partners; 
• to use our drone systems and enable them to manage and fulfill their tasks;  
• to comply with legal or other regulatory requirements and internal rules;  
• to establish, exercise and/or defend actual or potential legal claims, investigations, or similar proceedings; 

• for other lawful purposes, where such processing arises from the circumstances or was indicated at the time of collection. 

3.5. Personal Data Transmitted by Applicants 

We offer applicants the option to apply for job openings online on our Careers-site. You can apply for an open position by submitting your application via our application form and by accepting our Recruitment Privacy Notice where we provide information about how we process your Personal Data when you apply for an open position. You can also apply via email at careers@verity.net. In both cases, we will process the information you provide during a candidate selection process as set out in our Recruitment Privacy Notice. We use Breezy, an online hiring platform to make the application process for you and for us easy. More information about Breezy and their privacy policy you find here https://breezy.hr/policies/privacy. After completing the candidate selection process, all application data of unsuccessful candidates will be deleted within six months, except where we have your explicit consent to keep the application data for a longer period (e.g. for another open position we may have for you).   

4. Legal Basis of Data Processing 

The processing of this Personal Data is based on the following legal grounds:  

• your consent, only if it can be revoked at any time (e.g. if you sign up for our newsletter and other marketing communications).  
• for the fulfillment of a contract with you or your employer or for the intention to enter into a contract with you or your employer (e.g. concerning the purchase and operation of our drone systems)  
• to comply with any legal obligation (e.g. for tax purposes or for the purposes of any legal investigation or proceedings); or  
• to protect our legitimate interests (e.g. protection and security of our services, systems, assets; compliance with legal, regulatory and contractual obligations; assertion, exercise or defense of legal claims; customer support; maintenance and efficient organization of business operations, corporate governance and development; improvement and development of our products and services; promotion, sale and marketing of our products and services; for statistical analysis to improve and develop our products and services, and sale and acquisition of business units, companies or parts of companies and other corporate transactions). 

If the processing is based on your consent or our legitimate interests, you can withdraw your consent or object to this processing at any time by contacting us directly at dataprivacy@verity.net. Please note, however, that the withdrawal of your consent does not affect the lawfulness of the processing based on the consent prior to its withdrawal. 

5. Recipients of Personal Data  

Verity will take all necessary steps to ensure that only our authorized personnel and our agents, experts, service providers, suppliers, data processors and others, who have the necessary knowledge have access to your Personal Data in order to fulfil the purposes for which your Personal Data was collected.  

We may disclose your Personal Data to the following possible categories of recipients in accordance with the purposes and legal bases for processing described above, to the extent necessary for the intended data processing: 

• Verity’s affiliates at home and abroad  
• Experts and other service providers of Verity in the context of an enquiry 

• Service providers who process Personal Data on behalf of and at the instruction of Verity (so-called “order processors” such as in the area of IT, hosting and support)  
• Clients, partners, suppliers  
• Financial institutions, insurers, other business partners and auxiliary persons (e.g. lawyers) industry organizations, associations and other bodies 
• Social media platforms and visitors of our social media websites, acquirers or parties interested in acquiring business units, companies, or other parts of the Group; 
• Authorities, official agencies, regulators, arbitration bodies, courts or other state institutions (local, national or foreign) 

• Parties and other persons involved in potential or actual legal proceedings. 

We select our experts, service providers and partners as well as order processors carefully and only with sufficient guarantees that they have suitable technical and organizational measures in place to protect your data in accordance with the legal requirements. Our contract processors can only process Personal Data on documented instructions from us. They are all subject to confidentiality obligations and may only use your Personal Data to the extent necessary to fulfil the purpose for which your Personal Data was collected, unless otherwise required by law.  

6. Transfer of Personal Data outside the EU/EEA 

Personal Data collected through our Website will be stored in Switzerland and other locations around the world, e.g. where our subsidiaries, third party providers or partners are located. Therefore, we may transfer your Personal Data outside the European Economic Area (EEA) if this is necessary for the data processing described in this Privacy Notice in accordance with applicable law.   

If data is transferred to countries that do not provide an adequate level of protection, we will ensure adequate data protection by providing appropriate safeguards, such as contractual guarantees (e.g. on the basis of EU standard clauses), based on binding corporate rules, transfer of data pursuant to your explicit consent, for the conclusion or performance of a contract with you or with your employer, or in connection with the establishment, exercise or enforcement of legal claims. 7. Duration of Retention of Personal Data 

As a general rule, Personal Data is deleted or anonymized (or equivalent) as soon as it is no longer necessary to achieve the purpose for which it was collected, unless longer retention is necessary to comply with legal obligations (e.g. retention and documentation obligations for tax, insurance or accounting reasons), contractual or pre-contractual obligations or legitimate business interests of us (e.g. an interest for reasons of proof to assert, exercise or defend actual or potential legal claims, investigations or similar proceedings, or if we have an interest in non-personalized analysis). 

On this basis, we generally process Personal Data in compliance with the following rules and obligations: 

• The Personal Data automatically transmitted by you through the use of our Website (cf. point 3.1.) for the purpose of displaying, operating and ensuring the functionality of the Website will be deleted within three to six months. 
• The Personal Data you send us in connection with the use of our services and products that are offered on our Website or that you otherwise send us via the e-mail contact address will generally be stored by us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). 

• For contract-related Personal Data (including business documents and communications), we store Personal Data for as long as the contractual relationship exists and thereafter for at least a further ten years after termination of the contractual relationship, unless (i) in individual cases a shorter or longer statutory retention obligation applies, (ii) retention is required for reasons of evidence or for another valid reason under applicable law, or (iii) deletion of the data is required earlier (e.g. because the data is no longer required or we have to delete the corresponding data). 
• The Personal Data provided by an applicant, that was unsuccessful within a selection process, we delete it within six months after completion of an applicant’s selection process, except where we have explicit consent of the applicant to keep the application data for a longer period.

When you access or use our Websites, we may place so-called cookies – small text files – or similar tools on your computer. We use these cookies to recognize you as a user of the Website, to customize content, to improve the performance of the Website and to enhance its usability.

We use session cookies which are automatically erased when you close the Website and which enable the server to establish a stable connection to you as long as you browse on the Website. a) Google Analytics

Verity uses the Google Analytics 4 Website analysis service on its Website, which is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The cookies used by Google Analytics 4 are stored on your computer and thus enable an analysis of your use of the Website. 

We use Google Analytics 4 based on our legitimate interests to analyze and regularly improve our Website, as well as to regularly improve our offer via the statistics obtained and to make it more interesting for you. Furthermore, the use of Google Analytics is based on your consent to the tracking of your surfing behavior on our Website and its analytical evaluation.  

The information generated by the cookie about your use of this Website is usually transferred to a Google server in the USA and stored there. These cookies may contain the following information, for example: IP address, number, date and time of the visit, duration of the visit, your access page from which you use the Website (reference URL), the pages visited on our Website, browser type/version and operating system used. This Website uses the Google Maps API, a map service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This allows us to display interactive maps directly on the Website and enables you to use the map function conveniently.  

The legal basis of the processing results from your consent based on your voluntary information for the creation of a map and our legitimate interests in the presentation of our location and an easy location of the place indicated by us on the Website. 

By using Google Maps, information about the use of our Website, including your IP address, may be transmitted to a Google server in the USA and stored there. Google may transfer the information obtained through Google Maps to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. 

Google will not associate your IP address with any other data held by Google. Nevertheless, it would be technically possible for Google to identify at least individual users on the basis of the data received. It would be possible that Personal Data and personality profiles of users of the Website could be processed by Google for other purposes over which we have and can have no influence.   

It is possible to deactivate Google Maps and prevent data transfers to Google if you deactivate JavaScript in your browser. However, we would like to point out that in this case you will not be able to use the map display.

We use the social plug-ins below on our website in order to make our company better known. The underlying promotional purpose is to be regarded as a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. The responsibility for data protection-compliant operation is to be ensured by their respective providers. Data processing in connection with these plug-ins is carried out with your consent when you use these plug-ins. 

If you use the services of these social networks independently of or in connection with our website, the social networks evaluate your use of the plug-in. In this case, information about the plug-in is forwarded to the social networks.  

a) Facebook 

Our Website uses plug-ins from the social network Facebook, which is offered by Meta Platforms, Inc. 1601  Willow Road Menlo Park,  CA 94025, USA. The Facebook plug-ins are marked with a Facebook logo or the addition “Like” or “Share”. An overview of the Facebook plug-ins and their appearance can be found at: https://developers.facebook.com/docs/plugins. 

When you call up a page of our Website that contains such a plug-in, your browser establishes a direct connection to the Facebook servers. The content of the plug-in is transmitted by Facebook directly to your browser and integrated into the page. 

Through this integration, Facebook receives the information that your browser has called up the corresponding page of our Website, even if you do not have a Facebook profile or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there. 

If you are logged in to Facebook, Facebook can directly assign your visit to our Website to your Facebook profile. If you interact with the plug-ins, e.g. by clicking the “Like” button, this information is also transmitted directly to a Facebook server and stored there. The information is also published on your Facebook profile and displayed to your Facebook friends.

b) Instagram 

Our Website uses the plug-in of the social network Instagram, which is offered by Meta Platforms, Inc., 1601 Willow Road Menlo Park, CA 94025, USA.
